1. Agreement and contact
These Terms & Conditions ("Terms") govern your access to and use of Hoodsy's apps, websites, marketplace, Hood Board, messaging, payment, and related services (collectively, the "Services"). By creating an account, accepting these Terms, or using the Services, you agree to these Terms. If you do not agree, do not use Hoodsy. Questions or legal notices may be sent through in-app Support or to support@hoodsyapp.com.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter a binding agreement. Hoodsy may require age or identity verification before you post, apply for, accept, or perform a job. Posters may be asked to complete government-ID verification through Stripe; Helpers may be asked to complete identity verification and screening through Checkr. You must provide accurate, current information; protect your login credentials; and promptly report unauthorized use. You are responsible for activity conducted through your account. You may not impersonate another person, create deceptive accounts, or transfer an account without Hoodsy's written permission.
3. Hoodsy's marketplace role
Hoodsy provides technology that helps people who request work ("Posters") connect with independent people who choose to perform work ("Helpers"). Unless Hoodsy expressly states otherwise, Hoodsy does not perform jobs and is not an employer, employment agency, joint venturer, agent, contractor, or insurer of any user. Posters and Helpers decide whether to enter a job agreement and are responsible for that agreement, subject to these Terms and applicable law.
4. Jobs and user responsibilities
Posters must accurately describe the requested work, location, timing, price, risks, access requirements, and agreed tools or materials. Helpers choose which jobs to pursue and must perform accepted work safely, lawfully, professionally, and as agreed. Users are responsible for required licenses, permits, insurance, qualifications, tools, taxes, and compliance with applicable laws. Do not move payment or communications off-platform to evade safety controls or fees.
5. Prices, payment authorization, and fees
Before confirmation, Hoodsy will disclose the applicable price and mandatory fees. Posters authorize collection of the offered job price, a Hoodsy Poster Service Fee equal to 15% of that job price, and separately disclosed payment-processing charges, taxes, or other permitted amounts. Hoodsy does not charge Helpers a service fee on their agreed job earnings. If a Helper selects Instant Payout, Hoodsy deducts the displayed $2.00 Instant Payout fee from the available balance. The app will show the applicable price, fees, and payout amount before the relevant transaction is confirmed.
6. Payments, payouts, holds, and taxes
Hoodsy and its payment providers may charge authorized payment methods, correct payment errors, delay or hold funds while reviewing fraud, disputes, safety issues, chargebacks, legal obligations, or payment-provider requirements, and offset amounts a user owes where permitted by law. Payout timing is an estimate and may depend on bank and processor availability. Users are responsible for taxes, reporting, and records applicable to their activity; Hoodsy may collect tax information and issue required forms.
7. Cancellations, refunds, and payment disputes
A cancellation or refund depends on the job's status, work already performed, funds already paid, the reason for the request, any terms displayed before confirmation, and applicable law. Hoodsy may review supporting information and facilitate a resolution, but does not guarantee a particular result. Users must not submit false disputes or chargebacks. Contact in-app Support promptly if work cannot be completed, is materially different from the posting, or presents a safety concern.
8. Background checks and Verified Helper badges
Hoodsy may require Helpers to complete screening through an independent background-check provider and to provide separate notices, authorizations, and information required for that process. A Background Checked badge means only that Hoodsy's current records show the applicable background-check process returned a qualifying result when processed. An Identity Verified badge confirms only that the applicable identity and age check was completed; it does not mean a background check was run. Neither badge is an endorsement or guarantee of character, skill, future conduct, or safety, and either may be removed or updated. Users should exercise judgment and follow Hoodsy's safety guidance. Where applicable, consumer-reporting and adverse-action rights are provided separately from these Terms.
9. Safety and prohibited activity
You may not use Hoodsy for illegal, dangerous, deceptive, discriminatory, exploitative, violent, sexually explicit, or rights-infringing activity; controlled substances; weapons transactions; harassment; fraud; or work requiring credentials you do not hold. Do not share unnecessary sensitive information. In an emergency, contact local emergency services first. Hoodsy may remove content, cancel access to a job, limit features, or suspend an account to protect users or comply with law.
10. Hood Board, messages, photos, and other content
You retain ownership of content you submit. You grant Hoodsy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute that content as needed to operate, secure, improve, and promote the Services, subject to your privacy settings and applicable law. You represent that you have the necessary rights to submit the content. Hoodsy may moderate or remove content that violates these Terms, but is not required to pre-screen every post or message.
11. Reviews and communications
Reviews must reflect genuine job experiences and may not be manipulated, retaliatory, abusive, or misleading. Hoodsy may investigate and remove reviews that violate policy. You agree to receive transactional communications needed to operate your account and jobs. Marketing communications are subject to your choices and applicable law. Messages may be processed to deliver the Services, prevent abuse, investigate reports, and comply with legal obligations.
12. Privacy and third-party services
Hoodsy's handling of personal information is governed by its Privacy Policy and in-app privacy disclosures. Stripe or Checkr may collect government-ID images, selfies, dates of birth, identity numbers, device information, and other information needed to provide verification or screening. Hoodsy receives verification status and limited results needed to apply its eligibility rules and does not need to store ID images in the Hoodsy app. The Services may also rely on third parties for payments, maps, notifications, hosting, and analytics. Those providers may apply separate terms and privacy notices. Hoodsy is not responsible for third-party services outside its control, except as required by law.
13. Hoodsy intellectual property
The Services, Hoodsy name and marks, software, designs, and platform content are owned by Hoodsy or its licensors and are protected by law. Hoodsy grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, sell, reverse engineer, scrape, interfere with, or misuse the Services except where applicable law expressly permits it.
14. Suspension and termination
You may stop using Hoodsy or request account deletion. Hoodsy may investigate, restrict, suspend, or terminate access for violations, safety or fraud risk, legal obligations, nonpayment, or harm to the Services or users. Where appropriate, Hoodsy may provide notice and an opportunity to appeal. Provisions that by their nature should survive—including payment obligations, content licenses, disclaimers, liability limits, indemnity, and dispute terms—survive termination.
15. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Hoodsy does not guarantee that a user, job, posting, review, badge, background check, payment, or communication is accurate, safe, suitable, lawful, available, or error-free. Hoodsy disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
16. Limitation of liability
To the fullest extent permitted by law, Hoodsy and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, reputational harm, or losses arising from user conduct or job performance. Any limitation applies only to the extent lawful and does not limit liability that cannot be limited under applicable law. Your statutory consumer rights remain unaffected.
17. Indemnity and user disputes
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hoodsy and its affiliates from third-party claims and reasonable costs arising from your content, your jobs, your conduct, your violation of these Terms, or your violation of another person's rights. Posters and Helpers should first try to resolve job disagreements through Hoodsy Support. Hoodsy may assist, but users remain responsible for their direct agreements unless applicable law provides otherwise.
18. Changes, severability, and entire agreement
Hoodsy may update these Terms. If a change is material, Hoodsy will provide notice and request renewed consent when required. The effective date and version identify the terms presented to you. If any provision is unenforceable, the remaining provisions stay in effect. Hoodsy's failure to enforce a provision is not a waiver. These Terms and policies expressly incorporated into them are the entire agreement about the Services, subject to rights that applicable law does not allow you to waive.
